Terms and Conditions of Sale Effective from 10/03/2022

These Terms and Conditions of Sale apply exclusively to purchases made by Customers residing in Italy and providing an Italian delivery address.

These Terms govern online product sales carried out through www.slimcell.it(“Website”), operated by Duelegs Srl (“Seller”), headquartered at Via Tomasina 29, 46040 Guidizzolo (MN), Italy – VAT/Tax Code 01793770205.
Duelegs Srl owns the SlimCell® trademark, domain, and all related website content.

 

1. Scope

Online product sales constitute a distance contract governed by Italian Legislative Decree 70/2003 (e-commerce) and Articles 45 et seq. of the Consumer Code (Legislative Decree 206/2005).
The applicable Terms are those in effect on the date the order is submitted.

Submitting an order implies full acceptance of these Terms.

The Seller is not responsible for sales or services provided by third parties linked on the Website.

 

2. Purchases

Only consumers aged 18 or over may purchase through the Website.
Purchases may be completed with or without account registration. Registered users may:

  • view order status and order history

  • manage delivery addresses

  • submit return requests

  • update personal data and newsletter preferences

Customers guarantee that all data provided are accurate and truthful.
The Website is intended for retail use only: purchases for resale are forbidden.

Product availability is updated regularly. If a product becomes unavailable after the order has been placed, the Customer will be notified and refunded.

 

3. Contract Formation

To place an order, the Customer must complete and submit the online order form.
The contract is deemed concluded when the order is received by the Seller’s server.

A Order Confirmation email will be sent, containing:

  • essential product details

  • price

  • selected payment method

  • shipping costs

The order will be stored as required by law.

4. Product Availability

Each product page includes availability information.
If a product becomes unavailable after the order is submitted, the Customer will be notified and may cancel the contract and receive a refund.

 

5. Multiple Orders

If an order includes multiple items and only some are unavailable, the Customer may partially cancel the contract and receive a refund for the unavailable items.
Full cancellation is possible only when products are mutually dependent.

6. Product Information

Each product page includes a detailed description.
Images are for illustrative purposes and may differ slightly from the actual product due to display settings or production variations.
The product description in the order confirmation prevails.

7. Prices

All prices are in Euros and include VAT.
The price charged is the one displayed at checkout.

8. Purchase Orders

The Order Confirmation includes the order number, which must be used for any communication with the Seller.

The Seller reserves the right to refuse orders from:

  • customers involved in disputes

  • customers who previously violated contractual terms

  • customers involved in fraud

  • customers who provided false or incomplete data

9. Payment Methods

Accepted payment methods:

  • Credit/debit/prepaid cards (Visa, VPay, Mastercard, Maestro)

  • PayPal

  • Apple Pay

If the order is canceled before the charge is finalized, the payment authorization will be released by the issuing bank.

 

10. Delivery Terms, Costs and Methods

Products are shipped only within Italy.
Orders with delivery addresses outside Italy or in restricted zones (e.g., Livigno, Campione d’Italia) will be cancelled and refunded.

Shipping costs:

  • € 5.00 for orders below € 35

  • Free for orders € 35 or above, unless promotional terms apply

Average delivery time: 2–3 business days.

The Customer must check the integrity of the package upon delivery and report any issues with a written reservation on the courier’s document.

If the parcel cannot be delivered, it will be held in storage, and lack of response from the Customer may lead to contract termination and refund minus incurred delivery costs.

 

11. Right of Withdrawal

Customers may return products within 14 days from delivery, without penalties.

Returned products must be:

  • unused, unworn, unwashed

  • undamaged

  • complete with original packaging, labels, and security seal

The refund will be issued within 14 days of receiving the returned product, using the same payment method.

Returns that do not comply with these conditions will not be accepted.

12. Legal Guarantee of Conformity

Products are covered by a 2-year Legal Guarantee under the Italian Consumer Code.
Customers must report defects within 2 months of discovery and provide proof of purchase.

In case of a confirmed defect, the Customer is entitled to:

  • repair or replacement (primary remedies)

  • or, if impossible or excessively burdensome, price reduction or contract termination

13. Governing Law

The contract is governed by Italian law.
Any disputes shall be resolved by the court of the Customer’s place of residence.
